Terms Of Service

These Terms of Service ("Terms") govern your use of ALBI (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Educational and Wellness Content

ALBI provides educational and wellness content only and is not intended to diagnose, treat, cure, or prevent any medical condition. Always seek advice from a qualified healthcare professional regarding your health. The Service is not a medical device, and nothing in ALBI constitutes medical advice.

You are responsible for any decisions you make based on content in ALBI, and you should consult a qualified healthcare professional before making changes to your health, exercise, or nutrition routine.

2. Eligibility

You must be at least 16 years old to use ALBI. By using the Service, you represent that you meet this requirement and are legally able to enter into these Terms.

3. Your Account

You are responsible for keeping your account credentials secure.
You agree to provide accurate information and to keep it up to date.
You are responsible for all activity under your account.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful or harmful purpose.
Attempt to access another user's data or account.
Misuse, reverse-engineer, or disrupt the Service or its infrastructure.
Use the Service to provide medical advice to others.

5. Subscriptions and Payments

ALBI Premium is a paid subscription billed monthly or annually via Stripe in Australian dollars (AUD).
By subscribing, you authorise recurring charges until you cancel.
You can cancel at any time from your account settings or the Stripe customer portal; access continues until the end of your current billing period, and no further charges are made.
Unless required by law, subscription fees are non-refundable.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies conferred by the Australian Consumer Law or other applicable non-excludable laws. Where our liability for a breach of a non-excludable guarantee cannot be limited, our liability is limited, at our option, to resupplying the Service or paying the cost of having it resupplied.
Free trial or promotional access, if offered, may be discontinued at any time.

6. User Content

You retain ownership of the journal entries, reflections, photos, logs, and other content you create in ALBI ("User Content"). You grant us a licence to store, display, and process your User Content solely to provide the Service to you. You are responsible for the accuracy and legality of your User Content.

7. Intellectual Property

The Service, including its design, text, graphics, recipes, videos, and software, is owned by ALBI or its licensors and protected by intellectual property laws. You may not copy, reproduce, or distribute our content without permission.

8. Third-Party Integrations

The Service may connect to third-party fitness platforms (such as Fitbit and Strava). Your use of those platforms is subject to their terms and privacy policies. We are not responsible for their practices.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that results will meet your expectations. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, ALBI and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of data, health outcomes, or profits arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold ALBI harmless from claims arising from your use of the Service, your User Content, or your breach of these Terms.

12. Termination

You can delete your account at any time from Settings. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use poses a risk to the Service or others.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of that jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the app and updating the "Last updated" date. Continued use after changes constitutes acceptance.
